The UK’s supreme court has taken an expansive view of what constitutes a peril of the sea in a long running dispute over damage to an elderly jack up rig being carried on a barge around the Cape of Good Hope.
The five judges have unanimously declared that the loss of the legs of the Cendor MOPU was an insured peril even though the rig was not capable of surviving the weather to be reasonably expected on the voyage.
