One remarkable feature of Res Cogitans (PST Energy 7 Shipping LLC and another v OW Bunker Malta Limited and another) is the impressive speed with which the matter moved from arbitration to the UK Supreme Court.
Owners commenced London arbitration proceedings at the end of November 2014 and the Supreme Court handed down its judgment on 11 May 2016. Matters were of course helped, at least in terms of progression, as a result of a set of facts having been agreed.
