Chilean miner Codelco has suffered a setback in its legal bid to prevent GDF Suez-controlled terminal operator GNL Mejillones from reserving spare capacity for a select few off-takers.
The government-owned copper giant had asked the nation’s Free Competition Defence Tribunal to force the terminal joint venture to hold open seasons for spare slots “to ensure that said process is as competitive as possible”.
The tribunal threw out the request, however, saying the case is inadmissible because Codelco filed it as a so-called non-contentious consultation rather than launch a full legal battle.
