Golden Ocean has been cleared to bring a $54m claim against wealthy Indian businessman Anil Salgaocar and his mining company over a ten year charterparty alleged to have been repudiated.
Salgaocar failed to persuade a London appeal court to stop John Fredriksen controlled Golden Ocean pursuing a guarantee claim in England.
The main question before the court was whether undertakings given by Salgaocar on behalf of Salgaocar Mining Industries amounted to a charter guarantee although it was not contained in a single document.
