The dispute relates to early redelivery of Humpuss’ 73,000-dwt bulker Barito (built 1996) under an 11 to 13 month charter agreed in 2008.
Four months before the expiry of the contract Golden Ocean claimed the vessel was offhire and prematurely redelivered the ship.
The reason for the early termination of the charter did not figure in the London proceedings, which centred on Golden Ocean’s application for an injunction preventing the Indonesian shipowner pursuing arbitration in Singapore, and for permission to serve claims out of the jurisdiction of the London court.
The question of whether Humpass, or subsidiary Genuine Maritime, was Golden Ocean’s counterparty was also an issue as a result of confusion over draft and final versions of the charterparty.
