A London appeal court has ordered CMA CGM to pay $4.5m owed to a bunker supplier after a surprisingly hard fought battle that has led to an arbitration and various legal skirmishes.
The dispute centred on the supply by Petroval Bunker International of 8,500 tonnes of fuel oil to the 9,415-teu post panamax containership CMA CGM Fidelio (built 2006) part of which was claimed to be off specification.
The row over the January 2008 bunker supply appeared to be based on suspicions of what might happen with appeal court judge, Lord Justice Tomlinson describing it as a “somewhat arid dispute.”
